Unfortunately, some of the media reports of Mr Justice Bean’s judgment in the case of Harvey who was charged with assault on a police officer in the execution of his duty and with using threatening, abusive or insulting words or behaviour contrary to section 5 of the 1986 Act., have inaccurately stated that the result of this judgment is that swearing at police is no longer an offence.

This is not the effect of this judgment, in which the appeal succeeded because there was insufficient evidence to prove the charge.
