The Force has made a decision to staff the Cheltenham Festival using cancelled rest days. The money the Force receive from the racecourse, which in the past was used to pay officers overtime, will now go towards meeting its budget targets. Although the Force is well within its rights to staff the event using cancelled rest days it does have a duty to publish the duties of those required with 3 months notice. Due to the late notification of this decision most duties were not published with the required notice.
The Federation stance is that the Force has not complied with the requirements of Regulation 22 and should revert to paid rest day working. To date they have declined to do this. We are fully aware of the strength of feeling on this issue and are now in the process of obtaining legal advice from our solicitors. Once we have this advice we will disseminate it so that everyone is clear on what to do when challenging breaches of Regulation 22.
